CashControl is a personal finance manager platform that allows its users to monitor their expenses, incomes, bills, loans in an organised fashion with categories, financial accounts with the goal of offering a clear vision of the personal finances.

CashControl is operated by CashControl SRL, located in Str. Valea Fânațelor, Nr. 38, Apt. 1, Cluj-Napoca, Cluj, România, registered with the VAT number RO34489352, J12/1261/2015.

Acceptance of the terms

By registering, login and even accessing the www.CashControlApp.com website and this mobile app you are accepting the terms and conditions below, which you are in agreement with. If you do not agree with these terms, do not create an account and do not log into your account. Any accessing of the website will be considered your express acceptance of the below mentioned terms. The terms and conditions can be changed at any time, without prior notice and will be available online. As a user of www.CashControlApp.com you will use all the provided details on your own responsibility, and www.CashControlApp.com does not take any responsibility for any losses you might incur due to its use. CashControl will not sell or rent your personal information, and may disclose your personal information only as follows:

• to analyze the application usage and improve the service
• to deliver to you any administrative notices, money alerts and communications relevant to your use of the service
• anonymously for market research, project planning, troubleshooting problems, detecting and protecting against error, fraud or other criminal activity
• to generate statistics on usage
• to enforce the Terms of Use

Notwithstanding the foregoing, CashControl reserves the right (and you authorize CashControl) to share or disclose your personal information when CashControl determines, in its sole discretion, that the disclosure of such information is necessary or appropriate:

• To enforce our rights against you or in connection with a breach by you of this Privacy and Security Policy or the Terms of Use
• To prevent prohibited or illegal activities; or
• When required by any applicable law, rule regulation or other legal process.

CashControl guarantees the privacy of the data as set forth by the Romanian law 677/2003.

Reproducing partially or completely, under its original form or modified, of the information offered by CashControl is allowed only with the written consent of CashControl.

Warranties and Liability

CashControl makes no representations, warranties or guarantees, express or implied, regarding the accuracy, reliability or completeness of the content on www.CashControlApp.com or of the service, and expressly disclaims any warranties of non-infringement or fitness for a particular purpose. www.CashControlApp.com makes no representation, warranty or guarantee that the content that may be available through the service is free of infection from any viruses or other code or computer programming routines that contain contaminating or destructive properties or that are intended to damage, surreptitiously intercept or expropriate any system, data or personal information. www.CashControlApp.com is NOT intended to provide legal, tax or financial advice. www.CashControlApp.com is not a financial planner, broker or tax advisor. Notwithstanding anything to the contrary in this agreement, CashControl’s liability to you for any cause whatever and regardless of the form of the action, will at all times be limited to $100.00 (one hundred united states dollars).

Access suspention

In case of violation of these terms of service, CashControl can suspend access and delete the account to its services without prior notice or other justification.

Security

We use a combination of encryption techniques, firewall barriers and authentication procedures to maintain the security of your online session and to protect CashControl accounts and systems from unauthorized access. Our databases are protected from general employee access both physically and logically. We encrypt your password so that it can not be recovered, even by us. From the time you submit your Email and Password, these communications between your computer and www.CashControlApp.com are encrypted. This enables client and server applications to communicate in a way that is designed to prevent eavesdropping, tampering and message forgery.

Governing Law and Forum for Disputes

This Agreement, and your relationship with CashControl under this Agreement, shall be governed by the laws of the Romania without regard to its conflict or choice of laws provisions. Any dispute with www.CashControlApp.com, or its owners, employees and affiliates, arising under or in relation to this Agreement shall be resolved exclusively through the small-claims court of the Cluj-Napoca Court within the county of Cluj, Romania. You are giving up your right to serve as a representative, as a private attorney, or in any other representative capacity, or to participate as a member of a class of claimants, in any lawsuit involving any such dispute.
